All communities participating in the NFIP (including Honolulu, Kauaʻi, Maui and the Big Island) were recently sent an awareness letter on the Endangered Species Act (ESA). ESA compliance documentation has been required by FEMA for conditional letter requests for almost 10 years. FEMA released its Record of Decision in May 2018 announcing implementation of the preferred alternative from the NFIP’s programmatic Environmental Impact Statement (NPEIS). After FEMA develops policies to implement modifications to the NFIP in the coming months, the counties will be expected to maintain ESA compliance documentation for SFHA development. FEMA’s March 2019 notification also announced that ESA compliance documentation for a letter of map revision (LOMR) and a letter of map revision based on fill (LOMR-F) is going to be needed.
